1. No work made by the artist may ever be used in the making of AI Generated works or uploaded to any data pool for AI-Generating technology. No work made by the artist may ever be used for blockchain related technology such as NFTS, Cryptocurrency, or future inventions in this space.
2. Client may not trace, heavily reference, or claim the artist’s work as their own art.
3. No work made by the artist may be used to attack or marginalize anyone. The artist retains the right to have the artwork removed from anywhere using it in this case.Section 2 - Portfolio & Content Rights
1. The client retains the intellectual rights to their previously owned characters and projects and will be credited accordingly.
2. If the client provides references of designs that they do not have permission to use, the client will take sole responsibility for any issues, legal or otherwise, that should arise from this.
3. The artist retains the rights to post the work to any site for portfolio purposes, including live streams and process recordings. This may include any discussion of reference images provided by the client. Client may request certain materials remain private or delayed to be posted after a certain agreed upon date.Section 3 - Commercial rights
1. Commercial art rights will require additional terms and contract.
2. The client may not resell the artist’s work, use it commercially, or for promotion of a commercial project, unless there has been a mutually agreed upon usage. The artist retains the rights to any monetary profits made against these agreed upon terms of service.
3. If the commercial rights have been purchased separately or included with this commission, then the rights to use the design commercially may be transferred to the client upon receipt of the full payment of both the work and the commercial rights.
4. If the commission contains any new character designs that are completely designed by the artist (such as cartoon pet portraits) and are not designs previously owned by the client, the artist retains the right to reuse the design in any future project unless exclusive commercial rights to the design have been clearly granted to the client through a signed contractual agreement.Section 4 - Commission Process & Final Delivery Terms
1. Commissions under $150 must be paid in full before the artist will begin working. At least a half upfront payment is required for any projects over $150 to begin. Work on the commission will continue upon receipt of the second half of the payment.
2. All requested reference files must also be sent to the artist before work may begin so that the creative direction remains clear.
